SMS Consent Policy

1. Introduction

This SMS Consent Policy explains how UpsellPro obtains consent to send SMS messages to guests on behalf of vacation rental property managers. We are committed to responsible messaging practices and full compliance with the Telephone Consumer Protection Act (TCPA) and carrier requirements.

2. How Guest Information is Received

UpsellPro receives guest contact information through Property Management System (PMS) integrations. Property managers connect their PMS (currently Hostaway, with more integrations coming soon) to UpsellPro, which synchronizes reservation data including:

  • Guest name
  • Phone number (when provided during booking)
  • Email address
  • Reservation dates and property details

This information originates from bookings made on Online Travel Agencies (OTAs) such as Airbnb, VRBO, Booking.com, and direct booking channels.

3. Property Manager Call to Action (CTA)

When property managers sign up for UpsellPro, they agree to our Terms of Service which includes the following SMS consent requirements:

By using UpsellPro to send SMS messages, property managers represent and warrant that:

  • They have obtained proper consent from guests to send SMS communications about their reservations
  • Guests provided their phone number during the booking process and agreed to receive stay-related communications
  • They will only upload guest contact information for confirmed reservations
  • They will comply with all applicable laws including TCPA

This consent is collected during UpsellPro onboarding at https://upsell-pro.com/onboarding where property managers must accept our Terms of Service before connecting their PMS.

4. Guest Consent at Time of Booking

Guests provide consent to receive communications about their reservation when they complete a booking. This consent is obtained through multiple layers:

  • OTA Platform Consent: When booking through Airbnb, VRBO, or similar platforms, guests agree to the platform's terms which include receiving communications from hosts/property managers about their reservation.
  • Direct Booking Consent: For direct bookings, guests explicitly consent to communications when providing their phone number during the reservation process.
  • Transactional Nature: All messages sent through UpsellPro are transactional in nature, directly related to the guest's existing reservation.

5. Types of Messages We Send

UpsellPro sends only transactional messages related to the guest's reservation:

  • Welcome Messages: Booking confirmation and check-in information
  • Early Check-in Offers: Option to check in earlier than the standard time
  • Late Checkout Offers: Option to extend checkout time
  • Stay Extension Offers: Option to extend the reservation if availability permits
  • Reservation Updates: Important information about the guest's stay

We do not send promotional marketing messages, advertisements, or communications unrelated to the guest's specific reservation.

6. Message Frequency

Message frequency is limited and directly tied to the guest's reservation timeline. Guests typically receive 1-3 messages per reservation, sent at relevant times (e.g., before check-in for early check-in offers, before checkout for late checkout offers). We do not send recurring marketing messages or high-frequency communications.

7. How to Opt Out

Guests can opt out of SMS messages at any time by replying to any message with:

  • STOP - To stop receiving all SMS messages
  • UNSUBSCRIBE - Alternative opt-out keyword
  • CANCEL - Alternative opt-out keyword
  • QUIT - Alternative opt-out keyword

Opt-out requests are processed immediately and automatically.

8. Opt-Out Confirmation

When a guest opts out, they receive the following confirmation message:

“You have been unsubscribed and will no longer receive SMS messages from us. Reply START to resubscribe.”

After opting out, guests will not receive any further SMS messages unless they explicitly opt back in by replying START.

9. How to Get Help

Guests can get help or information about our messaging program by:

  • Replying HELP to any SMS message
  • Contacting the property manager directly
  • Emailing admin@upsell-pro.com

10. Data Handling

Phone numbers and messaging consent records are handled in accordance with our Privacy Policy. We maintain records of opt-out requests indefinitely to ensure guests who have unsubscribed do not receive future messages. We do not sell or share phone numbers with third parties for marketing purposes.

11. Carrier Disclosure

Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. For questions about your text or data plan, please contact your wireless provider.
